Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Poza’s websites, mobile and web applications, and related services (together, the “Services”). By creating an account, completing onboarding, or using the Services, you agree to these Terms.

1. Who we are

Poza is a financial technology company. We provide software and product experiences that may include multi-currency accounts, cards, payments, identity verification, and brokerage/investing features. Poza is not itself a bank. Regulated products are provided through licensed partners where required by law.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. Product availability depends on your location, identity verification outcome, partner eligibility rules, and applicable law. We may refuse, suspend, or limit access where we reasonably believe it is necessary for compliance, fraud prevention, or risk management.

3. Your account

You are responsible for the accuracy of information you provide, for keeping login credentials and passcodes confidential, and for activity on your account. Notify us promptly if you suspect unauthorized access. We may require you to complete identity verification (KYC), liveness checks, and related checks before certain features are enabled.

4. Identity verification and data use

To open or use certain Services, you authorize Poza and its service providers to collect, process, and store identity documents, biometric or liveness signals, personal details, and related verification results for onboarding, fraud prevention, regulatory compliance, and ongoing account administration. By continuing onboarding, you consent to that data use as required to provide the Services.

5. Partner services

Some features rely on third-party providers. For example, connected account or payment infrastructure may be provided by Airwallex, and US securities brokerage may be provided by Alpaca (or another licensed broker-dealer). Where you accept a partner’s terms during onboarding, those partner terms also apply to the relevant product. Poza is not responsible for partner outages or partner decisions outside our control, but we will work in good faith to help resolve issues that affect your Poza experience.

6. Cards, accounts, and payments

Card, wallet, and payment features may be issued or facilitated by licensed partners. Limits, fees, FX rates, settlement times, and supported corridors can change. You must use these features lawfully and only for purposes permitted by Poza and our partners. We may delay, reverse, or refuse transactions that appear high-risk, prohibited, or incomplete.

7. Investing

Investing involves risk, including loss of principal. Past performance is not a guarantee of future results. Brokerage accounts, market data, and trading features are subject to separate agreements and disclosures presented at account opening. You are responsible for your investment decisions.

8. Acceptable use

You agree not to:

  • use the Services for illegal activity, fraud, or sanctions evasion;
  • misrepresent your identity or provide false documents;
  • interfere with the security or integrity of the Services;
  • abuse promotional offers or attempt unauthorized access to other accounts;
  • use the Services in a way that violates partner or network rules.

9. Fees

Fees, FX spreads, and partner charges may apply depending on the product and corridor. We will disclose material fees in-product or in accompanying materials where practicable. You are responsible for taxes applicable to your use of the Services.

10. Intellectual property

Poza and its licensors own the Services, branding, and content (excluding your personal data and content you lawfully submit). You receive a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

11. Disclaimers

The Services are provided on an “as available” basis. To the fullest extent permitted by law, Poza disclaims warranties of uninterrupted availability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes liability that cannot be limited under applicable law.

12. Limitation of liability

To the fullest extent permitted by law, Poza is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the Services. Our aggregate liability for claims relating to the Services is limited to the fees you paid to Poza for the Services in the three months before the claim, except where prohibited by law.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or close accounts, or restrict features, if we reasonably believe you breached these Terms, failed verification, present elevated risk, or if required by a partner, regulator, or law.

14. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date and, where appropriate, by in-product notice. Continued use after changes become effective constitutes acceptance of the updated Terms.
